YOUR TRANSACTION DATA IS CONFIDENTIAL AND SHOULD NOT BE SHARED WITH ANY OTHER PERSON. 3. Service Charges for Inactivity. If the money order is not used or presented for payment within one year (three years in California) of the purchase date, there will be a non-refundable service charge applied where permitted by law. The service charge will be deducted from the amount shown on the money order. Subject to applicable law, the service charge is $1.50 per month (exceptions – CT &PR: $0; CA $0.25; MD $0.40; MN $12 annually; NJ $2; & TX $1) applied from the purchase date (from 13th month for NJ), not exceeding $126 or the maximum permitted by law.
4. Refunds. Refund requests must be made at https://westernunion.com/global/en/rmo-form.html. Refund requests must include the serial number, the amount, the date of purchase, the reason for refund, the purchase location, and an image of the money order or receipt with barcode. Refunds are only eligible for money orders that have not been presented or cashed. If Western Union is able to process the refund, you will be able to pick up cash in approximately five business days at any Western Union location using a unique Money Transfer Control Number. The refund amount is subject to any applicable service charges for inactivity and refund processing fees.
5. Refund Processing Fees. Refund requests are subject to processing fees of $0 for money orders with a face value of $5 or below; $5 for money orders above $5 and less than $100; and $15 for money orders with a face value of $100 or higher.
6. Stop Payments Upon Refund. Upon submission of a refund request, you the purchaser agree that Western Union need not stop payment on, or replace, or refund a lost or stolen money order unless (1) you filled in the face of the money order at the time of purchase, (2) you report the loss or theft to Western Union in writing immediately (if applicable), and (3) you provide Western Union with a copy of the receipt at Our refund request portal. A stop payment is placed on the original money order when a refund is made.

8. Limitation of Liability. WE SHALL NOT BE LIABLE FOR DAMAGES FOR DELAY, NONPAYMENT OR UNDERPAYMENT OF THE MONEY ORDER, WHETHER CAUSED BY NEGLIGENCE ON THE PART OF OUR EMPLOYEES OR PARTNERS OR OTHERWISE, BEYOND THE SUM EQUIVALENT TO US$500 (IN ADDITION TO REFUNDING THE PRINCIPAL AMOUNT OF THE MONEY ORDER MINUS APPLICABLE FEES), EXCEPT WHERE PROHIBITED BY LOCAL LAW. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. NOTWITHSTANDING THE FOREGOING, WE DO NOT EXCLUDE LIABILITY FOR ANY CONDITION OR WARRANTY THAT CANNOT BE EXCLUDED BY LAW INCLUDING ANY IMPLIED WARRANTY THAT WE WILL RENDER SERVICES WITH DUE CARE AND SKILL. OUR LIABILITY FOR THE BREACH OF SUCH CONDITION OR WARRANTY SHALL BE LIMITED TO THE GREATER OF THE COST OF PROVIDING THE AFFECTED SERVICE AGAIN AND THE SUM EQUIVALENT TO US$500, EXCEPT WHERE PROHIBITED BY LOCAL LAW. YOU MAY HAVE ADDITIONAL RIGHTS UNDER YOUR LOCAL LAWS, INCLUDING ATTORNEYS’ FEES AND THE COSTS OF PURSUING A DISPUTE, AND YOU MAY WISH TO EXPLORE THOSE RIGHTS. WE DO NOT GUARANTEE THE DELIVERY OR SUITABLILITY OF ANY GOODS OR SERVICES PAID FOR BY MEANS OF OUR MONEY ORDER SERVICES.
9. Arbitration. Unless you opt out as set forth below, any dispute between you and us, any of Western Union’s parents, subsidiaries, affiliates or Partners, or any of their employees, directors, or officers arising from or relating to any Transaction shall be resolved by final and binding arbitration. The arbitrator shall also decide what is subject to arbitration. Western Union’s parents, subsidiaries, affiliates or Partners, and any of their employees, directors, or officers are intended to be third-party beneficiaries of this Agreement. The arbitration will be administered by National Arbitration and Mediation (“NAM”) under its Comprehensive Dispute Resolution Rules and Procedures, which are available at https://www.westernunion.com/arbitrationinfo or by writing to 990 Stewart Ave., 1st Fl., Garden City, NY, 11530, and explain how to initiate arbitration. You will be responsible for up to $125 of the administration fees. We may reduce this amount if you demonstrate hardship. This Agreement is governed by the Federal Arbitration Act, and any award shall be subject to judicial confirmation. Any arbitration shall take place on an individual basis; class actions or arbitrations are not permitted. If any part of this paragraph is deemed invalid, it shall not invalidate the other parts. If NAM is unavailable, the parties or a court will select another arbitrator. You may opt out of arbitration with respect to a transaction within 30 days after initiating a transaction by calling 1-800-325-6000 within 30 days after initiating the transaction. IF YOU DO NOT OPT OUT, YOU WILL WAIVE ANY RIGHT TO A TRIAL BY JURY OR JUDGE IN COURT AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
10. Indemnity. You agree to indemnify and hold us, Our suppliers, vendors, service providers, and their respective subsidiaries, affiliates, officers, directors, agents, partners, employees, and consultants harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your misuse of the Services, your violation of these Terms or any law, or your violation of any rights of a third party.
11. General. These Terms are governed by Colorado law without regard to conflicts of law rules. Subject to applicable law, we may assign these terms to a third party without your consent. These terms still apply even if one or more of the provisions are invalid, unlawful, or unenforceable. The validity of the rest of the provisions is not affected. We shall not be liable for any failure or delay in the performance of the services to the extent such failure or delay is caused by matters beyond Our reasonable control. If any part of these terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
12. Additional Terms. These Retail Money Order Terms and Conditions may be supplemented by terms applicable to promotions, referral program, and other terms applicable to you based upon your use of Our other products and services. To the extent that any of these terms are determined to be in conflict with these terms, these terms prevail.
